Stork Rental Agreement

1. The Parties

This Stork Sign Rental Agreement ("Agreement") is between The Party Sets ("we," "us"), operated by Samantha Njoku, and the person booking the rental ("you," the "Renter"). The booking details you provide at checkout (name, contact, installation address, sign choices, add ons, and rental window) are part of this Agreement.

2. The Rental

You are renting a personalized 6 foot stork yard sign (boy, girl, neutral, or twins), with any add ons you select: reusable wood sibling or pet signs, custom wreath sash wording, or additional weeks. You reserve a window around your due date, and provide baby's name and birth stats once baby arrives.

3. Fees & Payment

1 day Sip & See or shower $55 · 3 day rental $80 · 7 day rental $95 · additional week +$35 · twins or multiples +$55 · sibling or dog sign $20 each · custom sash wording +$10 · delivery beyond 20 miles of OKC +$25.

Payment is due in full at checkout to reserve your date. Your reservation is not confirmed until payment is received.

4. How It Works

You reserve a window around your due date. When your baby arrives, text us the name and birth stats, and we install the sign during our evening install window, typically between 6 and 9 PM, usually within 24 hours of your text. We deliver, set up, and remove the sign for you. The wreath sash is yours to keep as your keepsake; the personalized bundle and all other pieces return to us with the stork.

5. Ownership

The stork sign, stakes, letters, numbers, the personalized bundle cutout, wood sibling and dog signs, and all components, except the wreath sash, are the property of The Party Sets and remain so at all times. They are rented to you, not sold, and must be returned in the condition delivered.

6. Responsibility for Loss or Damage

You are responsible for the sign and all components while they are on your property. Replacement fees for rental items returned damaged, lost, or stolen, or not returned: stork sign $200 · wood sibling or dog sign $30 each · ground stakes and hardware $15 · reusable name or number piece $5 each · personalized bundle cutout $25. The wood sibling and dog signs are rental items and return with the stork. The wreath sash is yours to keep, so no replacement fee applies to it. Normal weather exposure is expected and not charged. The Party Sets will charge the repair cost or the replacement fee, whichever applies. Any damage, loss, or theft fees are due within 7 days of removal and will be invoiced to you. For theft, you agree to provide a copy of a police report on request.

7. Placement & Underground Utilities

The sign is installed with ground stakes. You confirm that the requested placement area is clear of underground utilities, sprinkler lines, and irrigation, and that you have either completed an 811 utility locate or you authorize and approve the placement at your own risk. You grant The Party Sets permission to enter the property to install and remove the sign.

8. Care

Leave the sign where we place it (contact us if it must be moved). Do not move, alter, paint, or attach anything (balloons, tape, etc.) to the sign. Keep sprinklers off the sign and mow around it without removing the stakes.

9. Assumption of Risk, Waiver, Indemnification & Limitation of Liability

Assumption of risk. The sign is installed with ground stakes on your property. You assume all risk of injury, loss, or property damage related to its placement, presence, use, or removal.

Release and hold harmless. To the fullest extent permitted by Oklahoma law, you release, waive, and hold harmless The Party Sets and Samantha Njoku from any and all claims, liabilities, injuries, losses, or damage to persons, property, lawn, or underground utilities arising out of or related to the rental sign.

Indemnification. You agree to defend, indemnify, and hold harmless The Party Sets and Samantha Njoku from any third party claims, demands, or lawsuits, including by guests, family, neighbors, children, or any other person, arising from the sign while it is on your property.

Limitation of liability. The total liability of The Party Sets to you for any claim shall not exceed the amount you paid for the rental.

Unsafe placement or movement. The Party Sets may decline to install, or may relocate the sign, if a location appears unsafe. The Party Sets is not responsible for any damage or injury resulting from you moving or relocating the sign after installation.

Damage caused by the sign. You acknowledge the sign is staked outdoors and may tip, fall, shift, or be blown over. The Party Sets is not liable for any damage to vehicles, structures, landscaping, or other property, or for injury to any person, caused by the sign tipping, falling, shifting, or being blown over during the rental period, and you will indemnify and hold The Party Sets harmless from any such claim.

10. Weather & Acts of God

The signs are weather resistant but not weatherproof against severe conditions. The Party Sets is not liable for weather related damage or for a sign toppled by wind or storms. You agree to notify us promptly of any weather damage so we can address it.

11. Cancellation & Rescheduling

Late or early baby: no problem, we reschedule your install at no extra charge. Cancellation 7 or more days before the reserved window: full refund less a $15 admin fee. Cancellation under 7 days, or after personalization has been produced: 50% refund. After installation: no refund.

12. Photo Release

Unless you tell us otherwise in writing, you grant The Party Sets permission to photograph the installed sign and use the images for marketing and social media. No last names or street addresses are ever shown.

13. Governing Law

This Agreement is governed by the laws of the State of Oklahoma.

14. Entire Agreement & Severability

This is the entire agreement between the parties and supersedes any prior discussions. Any changes must be in writing and agreed to by both parties. If any provision is found unenforceable, the remaining provisions stay in full effect.

Acceptance. By checking the agreement box and completing checkout for a stork rental, you agree to all terms above, effective as of your order date.
